Intellectual Property Protection Policy

This Intellectual Property Rights Policy (“Policy”) sets forth the procedures for addressing concerns regarding the use of intellectual property on the website and related services (the “Platform”) operated by Zibiya (“we,” “us,” or “our”).

1. Scope of Protection

1.1. Copyright: We respect copyright law, which protects original works of authorship, including literary, dramatic, musical, artistic, and certain other intellectual works. 

1.2. Trademark: We recognize trademark law, which protects words, symbols, and designs used to identify and distinguish goods or services. 

1.3. Rights of Publicity: We acknowledge rights of publicity, which protect an individual’s right to control the commercial use of their identity.

2. Reporting Intellectual Property Infringement

2.1. Notice Requirement: If you believe that your intellectual property rights have been infringed by content on our Platform, you must provide us with a written notification (“Takedown Notice”) containing substantially the following: 

2.1.1. Identification of the specific copyrighted work, trademark, or aspect of publicity rights claimed to have been infringed. 

2.1.2. Identification of the material that you claim is infringing and information reasonably sufficient to permit us to locate the material (e.g., URL). 

2.1.3. Your contact information, including your full legal name, address, telephone number, and email address. 

2.1.4. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the intellectual property owner, its agent, or the law. 

2.1.5. A statement that the information in the notification is accurate, and under penalty of perjury, that you are the owner, or authorized to act on behalf of the owner, of the intellectual property right that is allegedly infringed. 

2.1.6. Your physical or electronic signature.

 2.2. Submission: Please send your Takedown Notice to our designated agent at: support@zibiya.com.

3. Our Response to Takedown Notices

3.1. Review: Upon receipt of a valid Takedown Notice, we will review the notice and the allegedly infringing material. 

3.2. Action: If we determine, in our sole discretion, that the material infringes upon the intellectual property rights identified in your Takedown Notice, we may remove or disable access to the infringing material. 

3.3. Notification: We will make reasonable attempts to notify the user who posted the allegedly infringing material of the action taken. We will also notify you of the outcome of our review.

4. Counter-Notification Procedure

4.1. Submission: If material you have posted has been removed or disabled as a result of a Takedown Notice, and you believe that the removal or disabling was the result of mistake or misidentification, you may submit a written counter-notification (“Counter-Notice”) to our designated agent at support@zibiya.com. Your Counter-Notice must contain substantially the following: 

4.1.1. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled (e.g., URL). 

4.1.2. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled. 

4.1.3. Your name, address, and telephone number. 

4.1.4. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which we may be found, and that you will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person. 

4.1.5. Your physical or electronic signature. 

4.2. Forwarding: Upon receipt of a valid Counter-Notice, we will forward it to the party who submitted the original Takedown Notice.
